LvlUp Privacy Policy

XQ.AI Marketing Ltd ("LvlUp," "we," "us," or "our") operates the LvlUp coaching platform. This Privacy Policy explains what information we collect, how we use it, and your rights. By using the Service, you agree to this policy.
1. Who This Policy Covers
This policy applies to end users of the LvlUp platform—people who participate in coaching, training, or assessments through an employer or organization that uses LvlUp ("Your Organization"). Your Organization has its own relationship with us and may have additional agreements about data.
2. Information We Collect
We collect information in these ways:
Information you or Your Organization provide:
- Name, preferred name, email address, phone number
- Employee or external ID (from Your Organization)
- Role, store or location, hire date
- Goals and other content you set or type in the platform (now or in the future)
Information from your use of the Service:
- Voice recordings of coaching and training sessions
- Transcripts of those conversations
- AI-generated summaries and feedback
- Engagement scores, understanding scores, and other analysis
- Login history (e.g., time, IP address, device) for security
Information from Your Organization:
- Performance or KPI data (e.g., sales metrics, transaction counts) that Your Organization uploads or syncs so we can personalize your coaching
3. How We Use Your Information
We use your information to:
- Deliver and personalize coaching, training, and assessments
- Store and display session transcripts, summaries, and scores to you and (where applicable) to Your Organization
- Improve our models and processes (e.g., how the AI coaches, how we score sessions). We use usage patterns and aggregated or anonymized data for this. We do not use your voice or likeness to train AI models.
- Send you transactional messages (e.g., account security, session reminders, password resets) and, if you don’t opt out, product updates and news
- Comply with law and protect the security of the Service
4. What We Don’t Do
- We do not use your voice or other biometric data to train AI or machine learning models.
- We do not sell your personal information. We don’t share it with third parties for their marketing.
5. Third-Party Service Providers
We use third-party providers for things like voice processing, cloud storage, artificial intelligence and machine learning, and data analytics. These providers process data on our behalf under contracts that require them to protect your information. We don’t list specific company names here because our providers may change; we use industry-standard categories and security practices.
6. Who Else May See Your Data
Your Organization may have access to your session data (e.g., transcripts, summaries, scores) and other information we hold about you, according to our agreement with them. They may use this for performance reviews, training, or other employment-related purposes. We are not responsible for how Your Organization uses that data.
Legal and safety. We may disclose information if required by law, to protect our rights or safety, or to prevent fraud or harm.
7. Data Retention and Anonymization
- We keep your data for as long as Your Organization is our customer, plus one (1) year after that relationship ends.
- After that period, we anonymize the data so it is no longer tied to you personally. We may keep anonymized data for analytics and improvement.
8. Data Deletion Requests
- If you want your data deleted before the retention period ends, the request must be made by Your Organization (e.g., your employer or their designated contact). We do not accept individual user deletion requests through the platform; that process is handled through Your Organization.
- This aligns with how the Service is set up: Your Organization is our customer and controls the account lifecycle.
9. Your Privacy Rights (Including California)
Depending on where you live, you may have rights such as:
- Right to know what personal information we have about you
- Right to delete (subject to exceptions; for LvlUp users, deletion requests are made through Your Organization)
- Right to opt out of sale of personal information — we do not sell personal information, so there is nothing to opt out of for sales

10. Security
We use reasonable technical and organizational measures to protect your information (e.g., encryption, access controls, secure hosting). No system is 100% secure; we cannot guarantee absolute security.
11. Children’s Privacy
The Service is not directed at anyone under 18. We do not knowingly collect information from people under 18. If you believe we have collected information from a minor, please contact us at [email protected].
12. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes through a notice in the platform (e.g., a banner). Your continued use of the Service after that notice means you accept the updated policy.
